2. Insurance Quotes and Applications

All insurance quotes provided through our website are estimates based on the information you provide. Quotes are not binding offers of coverage. Final premiums and coverage terms are determined by the insurance carrier after a complete underwriting review.

 

Providing false or inaccurate information on an insurance application may result in:

  • Denial of coverage

  • Cancellation of your policy

  • Denial of claims

  • Civil or criminal penalties for insurance fraud

4. Payments and Billing

By purchasing a policy through 365 Auto Insurance, you authorize us to charge your provided payment method for all applicable premiums, fees, and taxes.

 

Payment Terms:

  • Premiums are due as specified in your payment schedule at the time of purchase

  • Late payments may result in policy cancellation and coverage gaps

  • Returned checks or failed electronic payments may incur fees from your bank or from the carrier

  • You are responsible for keeping your payment information current and accurate

  • We may use third party payment processors to securely handle transactions

 

Refunds:

  • Refunds for cancelled policies follow your insurance carrier’s specific rules

  • Unearned premiums are typically refunded on a pro rata or short rate basis depending on the carrier

  • Some policies may charge cancellation fees that reduce your refund

  • 365 Auto Insurance service fees may be non refundable after your policy has been bound

 

5. Claims Process

To file a claim, contact our 24/7 claims hotline or use our online claims portal. We are available every day of the year, including weekends and holidays.

 

Your Claims Responsibilities:

  • Cooperate fully and promptly with the claims investigation

  • Provide all requested documentation including police reports, photos, and witness information

  • Do not admit fault or settle any claims without carrier approval

  • Take reasonable steps to protect damaged property from further loss

  • Notify us immediately of any changes in your circumstances that may affect the claim

Claims decisions are made by the insurance carrier, not by 365 Auto Insurance. We will advocate on your behalf throughout the process, but we cannot guarantee claim outcomes or payment amounts.

 

6. User Conduct

When using our website and services, you agree not to engage in any of the following prohibited activities:

  • Provide false, misleading, or incomplete information on any form or application

  • Use our services for any illegal purpose or in violation of any law

  • Attempt to gain unauthorized access to our systems, networks, or data

  • Interfere with the normal operation of our website or services

Our total liability to you shall not exceed the total fees you paid to 365 Auto Insurance in the twelve months preceding the event giving rise to the claim.

Some states do not allow certain limitations of liability. Some of these limitations may not apply to you.

 

9. Disclaimer of Warranties

Our services are provided on an “as is” and “as available” basis. 365 Auto Insurance makes no representations or warranties of any kind, express or implied, including:

  • Warranties of merchantability or fitness for a particular purpose

  • That our website will be uninterrupted, error free, secure, or free from viruses

  • That quotes or information provided will be completely accurate or up to date

  • That any insurance carrier will accept your application or pay your claim

We do not guarantee specific coverage, premiums, claim outcomes, or approval from any carrier.

 

10. Indemnification

You agree to indemnify, defend, and hold harmless 365 Auto Insurance, our employees, agents, officers, directors, and affiliates from any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney fees) arising from:

  • Your violation of these Terms and Conditions

  • Your use of our services

  • Your violation of any third party rights including insurance carriers and other drivers

  • Any false, inaccurate, or misleading information you provide

  • Your negligent or intentional acts or omissions

 

11. Third Party Links

12. Termination

  • Any pending quotes or applications may be cancelled

  • You remain responsible for any premiums due for active policies

Provisions that by their nature should survive termination shall survive, including liability limitations, indemnification, and dispute resolution provisions.

 

13. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. Any legal action or proceeding arising from these terms shall be brought exclusively in the state or federal courts located in New York County, New York. You consent to personal jurisdiction in those courts.

 

14. Dispute Resolution and Binding Arbitration

We encourage you to contact us first to resolve any disputes informally. Most issues can be resolved this way.

If we cannot resolve a dispute informally, you agree to resolve any claims through binding individual arbitration rather than in court, unless your claim qualifies for small claims court. Arbitration is conducted by a neutral arbitrator and is less formal than court.

 

Class Action Waiver: Class action lawsuits and class wide arbitrations are not permitted. You agree to bring claims only in your individual capacity. You may not act as a class representative or participate in any class action.

To initiate arbitration, you must send a written notice to our Legal Department describing your claim. The arbitration will be conducted by the American Arbitration Association under its consumer arbitration rules.

 

15. Severability

If any provision of these Terms and Conditions is found to be unenforceable or invalid by a court or arbitrator of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary. The remaining provisions shall remain in full force and effect.

 

16. Entire Agreement

These Terms and Conditions, together with our Privacy Policy, constitute the entire agreement between you and 365 Auto Insurance regarding your use of our services. They supersede any prior agreements, understandings, or representations, whether written or oral.

 

17. Waiver
